1. Service Description

FOUNDERFi BUILD is an AI-powered SMS automation platform designed for service businesses. Our platform provides automated lead response, appointment booking, review requests, and customer communication management. By using our service, you agree to these Terms of Service.

2. Reseller Obligations

As a reseller or end user of FOUNDERFi BUILD, you agree to:

  • Comply with all applicable laws including TCPA (Telephone Consumer Protection Act)
  • Obtain proper A2P 10DLC registration for SMS messaging
  • Secure proper consent from customers before sending SMS messages
  • Honor all opt-out requests within 24 hours
  • Maintain accurate business information and contact details
  • Not use the platform for any illegal or unauthorized purpose

3. Prohibited Uses

You may not use FOUNDERFi BUILD to:

  • Send spam, unsolicited messages, or harass any individual
  • Transmit any illegal, harmful, threatening, or defamatory content
  • Impersonate any person or entity
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to any part of the platform
  • Use the platform for any purpose that violates local, state, or federal laws

4. Payment Terms

  • Billing Cycle: Monthly subscription fees are charged in advance
  • Refunds: No refunds after 7 days from the billing date
  • Late Payments: Accounts may be suspended after 7 days of non-payment
  • Price Changes: We reserve the right to modify pricing with 30 days notice
  • Cancellation: You may cancel at any time; service continues until the end of the billing period

5. Service Level Agreement (SLA)

We target 99% uptime for our platform. This excludes scheduled maintenance windows (announced 48 hours in advance) and circumstances beyond our reasonable control, including but not limited to internet service provider failures, third-party API outages, or force majeure events.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDERFI LABZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE.

Our total liability to you for any claim arising from or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Intellectual Property

FOUNDERFi BUILD and all related content, features, and functionality are owned by FOUNDERFi LABZ and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform in accordance with these Terms.

8. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the service will immediately cease, and we may delete your data in accordance with our data retention policies.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in North Carolina.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the platform. Your continued use of the service after such modifications constitutes your acceptance of the updated Terms.
